JOHN B. KANTOR; FORMER ASSISTANT COMMISSIONER OF THE DEPARTMENT OF INVESTIIGATION

ROLE IN COVER UP:

BEFORE WORKING AT THE DOI, KANTOR WORKED FOR JUDGE GOLIA'S BROTHER AT THE DEPARTMENT OF BUILDINGS.

KANTOR TRANSFERRED THE SHEU CASE TO THE NYOD/OIG SQUAD AN AGENCY WITH NO JURISDICTION, AND BURIED IT.

The NYPD/DOI Squad is not part of the DOI. It is part of the NYPD and is therefore forbidden from investigating NYPD.  


Therefore; when Kantor gave the case to the NYPD/DOI Squad, he was knowingly giving the case to an agency without jurisdiction, and removing it from the DOI's legitimate jurisdiction. He buried it. 

KANTOR CONCEALED THE BSN COMPLAINT FROM THE SOLE AGENCY WITH JURISDICTION OVER THE CASE; THE OFFICE OF THE INSPECTOR GENERAL/ NYPD. 

Cantor never alerted the OIG/NYPD of the complaints against the NYPD. This represents:

S 215.40  Tampering with physical evidence.
  A person is guilty of tampering with physical evidence when:

  2. Believing that certain physical evidence is about to be produced or used in an official proceeding or a prospective official proceeding, and intending to prevent such production or use, he suppresses it by any act of concealment, alteration or destruction, or by employing force, intimidation or deception against any person. 
Tampering with physical evidence is a class E felony. 

It should be noted that both Asim Rehman, Chief Legal Counsel to the OIG and Elyse Hirschhorn, Counsel to the DOI both denied FOIL requests on the basis that the information responsive information could be used in a law enforcement investigation and.or a court proceeding. 

Therefore, by the OIG;s own assessment, Kantor's suppression of this information to the OIG falls under penal code S 215.40


On June 30, 2014, Kantor wrote: “DOI is continuing to obtain relevant records regarding Mr. Sheu’s death from several agencies. We have received some of the requested records, but we need to obtain further records"
